1. USE OF THE VEHICLE
The lessee receives the vehicle described above for rent in perfect working order with all the documents, tyres, tools and accessories, and undertakes to keep them and drive the vehicle according to the regulations of the Spanish law. Being expressly prohibited:
- Driving the vehicle by unauthorized persons in the contract.
- Transporting people or goods when this explicitly implies the sublease of the vehicle.
- Transport people or goods without having obtained the administrative authorization required by law. In case of non-compliance, the lessee will be responsible for the sanctions that could be imposed on the lessor by the administration.
- Driving the vehicle in inferior physical conditions, motivated by alcohol, drugs, fatigue or illness.
- Use the vehicle to push or tow other vehicles.
- Participate with the vehicle in races, sports contests, etc.
- Having the vehicle improperly parked or poorly secured when not in use.
- Unseal or manipulate the vehicle's odometer, and the lessor must immediately notify any fault in it.
- Travel outside the national road network or any unsuitable terrain, being expressly excluded from insurance coverage damage to the underbody of the vehicle or mechanical components that are damaged as a result of poor driving, as well as damage caused by travel in restricted areas of the road network.
- Not stopping the vehicle as soon as possible, when any warning light or alarm lights up, or sound(s) that indicates an anomaly in the operation of the vehicle or which is detected by the lessee. The lessee must contact the lessor or the insurance company so that they can arrange what is convenient. No repair or assistance other than that provided without prior authorisation from the lessor will be permitted.
- Driving the vehicle to another country without having communicated it to the lessor at the time of formalising the contract or later without YouDrive Rent a car granting its consent by any means which is recorded.
- Carrying out extreme or demanding sports driving that causes premature or abnormal wear of elements of the vehicle that do not correspond to the kilometres travelled and that originates from an excessive demand on the part of the lessor.
- Vary any technical characteristic of the vehicle, the keys, the equipment, the tools and/or accessories. In the case of breaching this article, the lessee must bear the expenses, duly justified, of reconditioning the vehicle to its original state, as well as paying an amount for immobilisation of the vehicle.
- Give away, rent, pawn, sell or use as any form of guarantee.
- Transport children under 3 years of age, or over 3 years of age who do not exceed a height of 150 cm, without using the corresponding restraint device, mandatory and approved according to the weight and size of the child. Installing child seats in the front passenger seat is completely forbidden, since in the event of an accident the airbag could explode, causing serious injury to the child.
- Exceeding the established speed limits.
- If the car is returned with more than 1000 kilometres extra.
- To provide as a security, pledge, sell, rent, assign, mortgage, loan or even change or modify any part of the vehicle, including the documents, keys, tools and accessories, or the vehicle itself.
- The lessee MUST lock the vehicle correctly, in a suitable, appropriate and safe place when it is not being used, and keep its documentation inside the vehicle.
2. RETURN OF THE VEHICLE
The lessee will return the rented vehicle together with all its documents and keys, in the place and on the date stipulated in the contract. Any alteration must be previously authorised in writing by the lessor. Failure to comply with this condition entitles the lessor to judicially require the return of the vehicle and charge the customer's credit card for extraordinary service fees.
3. RENTAL CHARGES
The lessee agrees to pay the lessor:
- For any exceptional services that you contract, use, or incur. The application of the conventional rate is initially suspended until the refund is made.
- The charges caused by the loss of vehicle documentation, as well as the loss of tyres, tools, accessories, etc.
- The costs of repairing the damage caused to the vehicle in the event of an accident when the following circumstances occur:
1. That the vehicle was not used in accordance with the established conditions
2. That the accident report had not been completed within the indicated period or that it did not conform to the reality of the events that occurred.
- Fines and legal expenses caused by traffic violations or violation of laws by the lessee.
- In case of wrong refuelling, the customer will pay all the expenses incurred (crane, emptying tanks, etc.)
- Exceptional cleaning or upholstery repair. Those produced by chewing gum, resins, acids, oils, inks whenever they require the use of specific unusual products, understanding water, soap and conventional cleaners as usual. The cost of this cleaning will be decided after careful examination of the damaged or dirtied area.
4. CANCELLATION POLICY
A charge of 30% of the total service is established with a minimum of €100 if the reservation is cancelled 10 to 14 calendar days before the start of the rental. 60% with a minimum of €150 if cancelled between 6 and 9 days and 80% with a minimum of €150 if cancelled between 2 and 5 days. This percentage being 100% of the service with a maximum of €1000 if the vehicle is not picked up.
5. FUEL
The vehicle will always be returned with a full tank, using the correct type of fuel.
6. ACCIDENTS
In the event of an accident, the lessee agrees to:
- Obtain the complete data of the other party and possible witnesses, completing an accident report, which will be sent by the lessor, within a period of 24 hours after the accident occurred.
- Not leave the rented vehicle without taking adequate measures to protect it.
- Immediately notify the lessor of the accident.
7. LIABILITY OF THE LESSOR
The lessor declares that it has taken the necessary precautions to avoid mechanical failures of the rented vehicle, but in the event of such failures, it does not assume any responsibility for the damages caused to the lessee directly or indirectly, as a consequence of said failures or breakdowns.
8. CHARGES ON CREDIT CARDS
The lessee, by signing this contract, authorizes YouDrive Rent a Car to charge their credit card for any amounts agreed upon or pending at the end of the contract, either for rent payment, damages caused not covered by insurance, or any other attributable charge by the lessee, who will be supplied with a breakdown of the charges.
9. ROAD ASSISTANCE INSURANCE
The rental contract includes roadside assistance service.
10. TRANSPORTATION AND COLLECTION OF THE VEHICLE IN A DIFFERENT ADDRESS FROM THE USUAL
The lessee may request the lessor to transport the vehicle to a different address than usual, as well as for its collection. Said service must be requested together with the lease of the vehicle, a surcharge may be applicable and the lessee cannot demand its later contracting without the consent of the lessor.
11. REQUIREMENT TO THE DRIVER
The lessee and the drivers named in this contract must meet the following requirements:
- Valid driving license for the vehicle hired, a photograph of both sides must be sent upon the hire request.
- Be over 25 years old and hold a full driving licence for a minimum of 2 years.
- Provide ID, residence card or passport with a valid address plus photocopy or photograph sent to lessor.
12. PROTECTION OF PERSONAL DATA
We inform you that your personal data will be processed in a client file under the responsibility of YouDrive Rent a Car. The processing of your data is necessary for the development of the commercial relationship that binds us and may be subject to mandatory assignments according to current regulations. Likewise, and for security reasons, the lessee authorises the lessor to access the positioning of the vehicle through telematic means at any time during the duration of this rental contract.
13. The lessee will sign a copy of thie contract before taking the vehicle agreeing to all the points above.
